To Enter: Visit www.facebook.com/gemex during the Sweepstakes Period and request to become a GEMEX fan on Facebook. If you already have a Facebook account you can direct access the GEMEX page on FACEBOOK to locate the “Become a Fan” selectable button. If you do not have a Facebook account, you will need to go to the Facebook sign-up page first. After your Facebook account has been created, proceed to the GEMEX page to locate the “Become a Fan” selectable button. Your request to be one of the first one thousand (1,000) fans of GEMEX on Facebook automatically gives you one entry. You may only enter one time. You must be a GemEx fan in good standing at the time of the drawing to win. A valid Facebook account with a requisite email address is required to be automatically entered into the sweepstakes and, after the time of the drawing, to be notified of the drawing results. All entries must be received between 12:00.01 (ET) on March 29, 2010 and 11:59.59 PM (ET) on July 04, 2010.
Only the first one thousand (1,000) registered fans will be eligible for the 1000 Fans Sweepstakes drawing. GemEx’s computer is the official clock of this Sweepstakes. GemEx will not verify receipt of entries. Use of script, macro, or other automated systems to participate is prohibited and will result in disqualification. GemEx and its agents are not responsible for lost, late, illegible, incomplete, misdirected transmissions, or problems of any kind whether mechanical, human, or electronic. Sweepstakes entries or any kind are the property of the GemEx.
Eligibility:Only open to residents of the 50 United States and the District of Columbia who have had Internet access prior to the first date of this promotion, age 18 and older at time of entry and who have a valid Facebook® account. Please ensure that your Facebook account profile is up-to-date with a valid email address. GemEx will only notify a potential winner via their personal Facebook account. No other method of notice will be given. Employees of GemEx Systems, Inc. (“GemEx”), and any of its, affiliates, franchisees and their employees, licensee, distributors, suppliers, subsidiaries, retailers, advertising/promotion agencies (collectively “Released Parties”) , and members of their immediate family (spouse, parents siblings, children or “step” of each, regardless of where they reside) and/or those living in the same household of each (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of this Sweepstakes) are not eligible to participate. All federal, state and local laws and regulations apply. This promotion is intended for viewing in the United States only and shall only be construed and evaluated according to the United States law. You are not authorized to participate in the Sweepstakes if you are not located within the United States. Void in Puerto Rico and where prohibited or restricted by law.
Prize Details: One (1) Prize awarded at the end of the Sweepstakes Period: One carat total weight diamond earrings. Approximate retail value: $3500. No prize substitutions allowed and no cash alternatives, in whole or in part, are available, except that GemEx reserves the right to substitute a prize of equal or greater value as determined by GemEx. Prize is non-transferable. By accepting prize, winners consent to the use of their name and/or likeness for advertising and publicity purposes worldwide without limitation and without additional compensation, except where prohibited by law. All federal, state or other taxes on prize are the winner’s sole responsibility. Limit one prize per household.
Drawing and Awarding of Prize: Potential winners will be determined in a random one time drawing from all eligible entries received. The drawing will be held on or about Tuesday July 6, 2010 following the Sweepstakes Period ending on Sunday, July 4, 2010 at 11:59:59 pm CST. Non winning entries will roll over into subsequent drawings, if any. Odds of winning are not less than 1 in 1,000 and are determined by the number of eligible entries received up to the maximum of 1,000 entries. Potential winners will be notified via Facebook electronic broadcast transmission to all fans of GemEx and if visible to GemEx on their Facebook account pages, by phone, or email, or registered mail to their mailing address, no later than on or about the 5th day following the drawing date. If potential winner cannot be reached within seven (7) calendar days from the first notification attempt, then such person shall be disqualified. Unclaimed prizes will not be awarded. In the event of a dispute as to an entry, the authorized account holder of the email address used to create the Facebook account profile will be deemed to be the potential winner. The authorized account holder is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder and to provide a valid tax identification number. Proof of eligibility is required in order for potential winner to claim the prize. Winner will be required to sign an affidavit of eligibility and liability/publicity release which must be returned within seven (7) days of receipt or prize will be forfeited. Prize will be issued to person listed on the Facebook account profile. If winner is deemed a minor in his/her state of residence, prize will be awarded in the name of a parent or legal guardian who must sign and return all documents within the required period.
Limitation of Liability: Winner agrees that (except where prohibited) GemEx may use winner’s name, picture, portrait, likeness and voice for advertising and promotional purposes without further compensation. Released Parties shall have no liability, without limitation, and shall be held harmless by winner for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse of prize or participation in this Sweepstakes. Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded shall be resolved individually, without resort to any form of class action. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorney’s fees. GemEx reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes for any reason or should virus, bugs, non-authorized human intervention, fraud, technical failures or other causes beyond the control of the GemEx corrupt or impair the administration, security, fairness or proper play of the Sweepstakes. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the promotion. In such event, GemEx may, at its sole discretion, award prize in a random drawing from all eligible entries received up to the date of cancellation or suspension. GemEx and agents are not responsible for any human error, omission, interruption, defect or delay in transmission, transaction processing or communication; technical or mechanical malfunctions; failures or malfunctions of phones, phone lines, or telephone systems, printing errors in these Official Rules or any other advertising materials, failures of electronic equipment, computer hardware or software, or inaccurate entry information, whether caused by equipment programming used in this Sweepstakes, human processing error or otherwise; lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by the GemEx, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. GemEx may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or GemEx representatives. If, for any reason, an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the promotion. GemEx reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes and select winners from all eligible entries received prior to action taken or as otherwise deemed fair and appropriate by GemEx. Except where prohibited, by participating you agree to these Official Rules and to the decisions of GemEx and/or the independent judges whose decisions are final and binding in all respects. Failure to comply with these Rules may result in disqualification.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, GEMEX RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
Miscellaneous:Entrants who violate these Official Rules are subject to disqualification. GemEx is the sole arbiter of whether conduct by an entrant constitutes a violation of these Rules whose decisions will be final. All issues concerning the construction, validity, interpretation and enforceability of these Rules shall be governed by and construed in accordance with the laws of the State of Wisconsin, without giving effect to any choice of law or conflict of law rules. By entering this Sweepstakes or accepting a prize, entrants agree to be bound by the decisions of GemEx and these Official Rules and to comply with any federal, state and local laws and regulations.
